Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and THYNX LLC, a Colorado limited liability company doing business as GOEDTEST ("GOEDTEST", "we", "us", "our"). By accessing or using the GOEDTEST website, the GOED Test, or any related service (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

GOEDTEST is provided for educational and informational purposes only. Recommendations generated by the GOED Test — including USDA growing zones, climate profiles, suggested foods, hidden gems, planting advice, or grower listings — are general guidance and are not a substitute for professional advice from a horticulturist, agricultural extension agent, soil scientist, attorney, accountant, doctor, or any other professional.

Growing success may vary based on local climate, microclimates, soil conditions, pests and disease pressure, water availability, local regulations (including HOA and municipal rules), invasive-species restrictions, your gardening experience, and many other environmental and personal factors.

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction, you must have permission from a parent or legal guardian.

If you create a grower listing, submit a food source, contact us, or otherwise provide information to GOEDTEST, you represent that the information is accurate and that you have the right to share it. You agree not to:

• Submit false, misleading, or fraudulent information.
• Use the Service to harass, defame, or harm any person or business.
• Attempt to gain unauthorized access to the Service or other users' data.
• Scrape, crawl, or bulk-extract data from the Service without our written permission.
• Use the Service in violation of any applicable law.

You grant GOEDTEST a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display the content you submit, solely as needed to operate and improve the Service. You retain ownership of your content.

The Service, including the GOEDTEST name and logo, the GOED Test methodology, the food database, written content, design, code, and underlying technology, is owned by THYNX LLC and is protected by copyright, trademark, and other intellectual property laws. You may view and use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or create derivative works from the Service without our prior written permission, except as expressly permitted by applicable law.

The GOEDTEST directory may include listings, profiles, and links submitted by growers, farms, markets, and other third parties. GOEDTEST does not endorse, verify, or guarantee the accuracy of any third-party listing or external link, and we are not responsible for the products, services, content, or practices of any third party.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or availability. GOEDTEST does not warrant that the Service will be uninterrupted, error-free, secure, or that any food recommendation will grow successfully in your specific location.

To the maximum extent permitted by law, in no event will THYNX LLC, GOEDTEST, or our officers, members, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages.

To the extent we are liable for any direct damages, our total aggregate liability for any claims arising out of or related to the Service will not exceed the greater of USD $100 or the amounts you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless THYNX LLC and its officers, members, employees, contractors, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law) will survive.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Broomfield County, Colorado, and you consent to personal jurisdiction and venue there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
